These Terms of Service ("Terms") govern your access to and use of the Digital Guidebooks platform, including the digitalguidebooks.co website and the digitalguidebook.co application (collectively, the "Service"), operated by Digital Guidebooks ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Digital Guidebooks provides a platform for tour operators to create, manage, and distribute digital guidebooks to their guests. The Service includes guidebook creation tools, email collection, guide tipping, review prompts, referral tracking, analytics, and related features as described on our website.
The Service offers Free and paid subscription plans. Current pricing is available on our Pricing page. We reserve the right to change pricing with 30 days' notice to active subscribers.
Paid plans are available on monthly or annual billing cycles. Annual plans are billed upfront for the full year. Monthly plans are billed at the beginning of each billing period.
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel at any time from your account settings.
When you cancel a subscription, you retain access to paid features until the end of your current billing period. After that, your account reverts to the Free plan. We do not offer prorated refunds for partial billing periods.
Founding Member subscriptions are billed annually at $2,500/year. The Founding Member price is locked for the lifetime of the subscription and will not increase as long as the subscription remains active. Founding Member spots are limited and non-transferable.

You retain ownership of all content you create or upload to the Service, including guidebook content, images, and branding. By using the Service, you grant us a limited license to host, display, and distribute your content as necessary to provide the Service.
The Service, including its design, code, features, and documentation, is owned by Digital Guidebooks and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring that your collection and use of guest data through the Service complies with applicable data protection laws, including obtaining any necessary consents from your guests.
To the maximum extent permitted by law, Digital Guidebooks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay applicable fees. You may terminate your account at any time by contacting us or canceling your subscription through account settings. Upon termination, your right to use the Service ceases immediately, and we may delete your data after a 30-day grace period.
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
